I totally misread the poll question when I voted before looking at the video (I can fix that in the database).
It's up to whomever owns the wireless router to secure it. If they leave it open and unlocked, especially in the context of this story (where they offer access free of charge to customers). If it said "free access", that's a totally gray area.
It would be better to lock it down with a password that you rotate daily, and then give your customers that days password.
