I guess you should ask permission before using someone's picture for your product branding.
Well, from the article, they -did- have his permission, for products in Canada. BUT, they ened up using him and never paying him; never notifying him he -was- going to be used. Bad on them. Unfortunately, he never noticed until 16 years later when he looked at the label.
Interesting how the jury awarded a big settlement, over and above what he was originally asking. Details are private of course.
I say good for him.
